II. Dispute In Which The Legal Support Subject To The Contract Will Be Given:

III. Litigation Expenses    :

1. The subject of dispute is within the scope of consumer law / commercial law and mediation application should be made in accordance with Turkish law. For this reason, mediation negotiations will be held first. In this cese, client will pay ……….TL for the translation of the  necessary documants, in advance. If an agreement cannot be reached during the mediation process, a lawsuit must be filed. If a lawsuit is required, the court fees and expenses will be paid as follows.

• Court fees and expenses will be borne by the client. The client will pay ……….. TL more in advance to the attorney for court expenses.

• If the costs related to the case increase, these costs will be paid by the client to the lawyer or the court that made the trial. At the beginning of the trial or during the continuation of the legal proceedings, the lawyer cannot be held responsible for the litigation expenses that are not paid to the lawyer or the court even though the client has been notified, and for the resulting damage.

• If the client, after filing the lawsuit, wants the dispute to be resolved out of the case through mediation, amicable or waiver, he will notify the lawyer of this.

IV. Attorney Service Fee  :

The client will pay the fixed attorney’s fee of ………… TL, which is the equivalent of legal support, in advance.

Attorney’s Fee By Case Value (To Be Awarded By Court):

Apart from the fixed attorney’s fee to be paid in advance; the dispute that is the subject of legal support;

• If a settlement is reached between parties in mediation stage, if the fixed attorney’s fee of ……… TL remains below ten percent of the contract price, this fee will be completed in a way that corresponds to ten percent of the contract price.

• In the event that an agreement cannot be reached in the mediation process and a lawsuit is filed, the attorney will be paid a relative attorney’s fee of 10 percent (10%) of the monetary amount to be decided by the court in favor of the client.

Attorney’s Fee By Counterparty (To Be Awarded By Court):

The attorney’s fee determined by this contract and the counter attorney’s fee determined by the lawsuit or execution, are completely independent of each other. The client states that the counter attorney’s fee to be determined by the court belongs to the lawyer; even if the case ends with an agreement, he accepts that the counter attorney’s fee to be calculated belongs to the lawyer.

V. Other Agreed Terms

1. After the lawsuit is filed, if the dispute is settled by methods such as settlement, waiver or mediation, the lawyer is paid the full fee.

• The validity period of the power of attorney given to the lawyer by the client has been determined as ……. At the end of this period, if the case has not been concluded or the court decision has not been finalized or if the execution proceeding regarding the court decision and the money awarded have not been collected, the client will issue a new power of attorney to the lawyer.  At the end of the determined period, if the client does not extend the attorney representation period and does not allow the attorney to follow the case, pursue enforcement proceedings or collect money; the client will have to pay to the Attorney, full of the fixed attorney’s fee, full of the attorney’s fee by case value, and full of the attorney’s fee by counterparty (to be awarded by court), in accordance with this contract and the attorneyship law.

• The Attorney will follow the work undertaken under this contract to the end in accordance with the laws and professional rules. The lawyer can perform this task himself or, under his supervision, cooperate with other lawyers and give them authority under his own responsibility. However, in these cases, he will be personally liable to his client and will not ask for additional fees from the client.

• The client cannot give a power of attorney to another lawyer for this work without the written consent of the lawyer. On the contrary, the act constitutes a justified reason for resignation, and in this case, the lawyer is paid the full fee.

• After the start of legal support, if the client waives the case or does not give the lawyer the opportunity to follow the work or does not fulfill his obligations under the contract, the lawyer is entitled to demand all the remaining fees.

• If the contract is terminated unilaterally by the client before the deadline, the attorney gains the right to demand the entire attorney’s fee.

• The client has accepted the address written in this contract as his legal residence, valid telephone number and e-mail address. Any notice of the attorney to his client will be sent to these addresses. It is obligatory to notify the lawyer of the change in contact information. Otherwise, the lawyer cannot be held responsible.

• Turkish Law and Mersin courts and enforcement offices will be authorized to resolve disputes arising from this attorneyship contract signed between the parties and attorney’s fees by means of judicial jurisdiction.

•  In matters not covered in this contract, the provisions of the Attorneyship Law will be applied as a supplement.
